תקנון אתר GOLDA

כללי:
GOLDA היא הבעלים הבלעדיים של אתר https://www.goldagift.com, אשר מציע למכירה תכשיטים בעבודת יד בשילוב הקדשה מוזיקלית מותאמת אישית (להלן: "המוצרים").
השימוש באתר כפוף לתקנון זה ומהווה הסכמה מצד המשתמש (להלן: "הלקוח") לכל התנאים המפורטים בו. תקנון זה מנוסח בלשון זכר מטעמי נוחות בלבד, ומתייחס לשני המינים באופן שווה.

רכישה באתר:

הרכישה באתר מותרת לגילאי 18 ומעלה בלבד או באישור אפוטרופוס חוקי.

ביצוע הזמנה באתר מהווה התחייבות מלאה מצד הלקוח לכל התנאים המפורטים בתקנון.

לאחר ביצוע ההזמנה ותשלום מלא, יישלח ללקוח אישור במייל, וההזמנה תטופל בהתאם.

הרכישה נעשית באמצעות טופס הכולל פרטים אישיים מלאים, פרטי תשלום, ובמקרה של הקדשה מוזיקלית – מילוי טופס תוכן ייעודי.

הקדשה מוזיקלית:

שיר ההקדשה נבנה באופן אישי וייחודי לפי מידע שסיפק הלקוח בטופס ההזמנה.

לאחר קליטת ההזמנה ואישורה, מתחיל תהליך ההפקה באופן מיידי.

לא ניתן לבטל או לשנות את ההקדשה לאחר תחילת ההפקה – לרבות מילים, סגנון, לחן או הקלטה או כל הקשור לכך.

אספקה ומשלוחים:

אפשרות המשלוח היחידה היא שליח עד הבית בעלות של 35 ש"ח.

הזמנות מעל 499 ש"ח יישלחו ללא עלות משלוח.

אין אפשרות לאיסוף עצמי.

אין משלוחים לחו"ל בשלב זה.

זמני אספקה:

תכשיטים רגילים: עד 5 ימי עסקים ממועד המשלוח.

תכשיטים עם הקדשה מוזיקלית: 7–10 ימי עסקים ממועד המשלוח.

אחריות הלקוח לוודא שניתן ליצור עמו קשר לתיאום.

ביטולים והחזרות:

ניתן לבטל עסקה ולהחזיר מוצר רגיל (ללא הקדשה מוזיקלית) תוך 14 ימים מיום קבלתו, בתנאי שלא נעשה בו שימוש והוא באריזתו המקורית.

ייגבו דמי ביטול בגובה 5% או 100 ש"ח – לפי הנמוך מביניהם.

דמי משלוח ששולמו אינם ניתנים להחזר.

לא ניתן להחזיר או לבטל רכישה של תכשיט עם הקדשה מוזיקלית או תכשיט שיוצר בהתאמה אישית, בהתאם לסעיף 14(ג) לחוק הגנת הצרכן.

במקרה של פגם במוצר, יש לפנות תוך 3 ימי עסקים בצירוף תיעוד. לאחר בדיקה, יישלח מוצר חלופי.

החזרים יתבצעו באמצעות זיכוי כספי בלבד.

אין אפשרות להחלפות או לזיכוי באשראי באתר.

אחריות ושמירה על המוצר:

GOLDA מתחייבת לגימור מוקפד ולבקרת איכות על כל מוצר.

אין אחריות לנזק שנגרם עקב שימוש שגוי, מגע עם מים, בושם, אחסון רטוב או מכות פיזיות.

הוראות תחזוקה:

אין למתוח או למשוך את התכשיט.

יש להסירו לפני רחצה, ים או בריכה.

יש לאחסנו בקופסה סגורה במקום יבש.

יש להימנע ממגע עם חומרי ניקוי, קרמים או בשמים.

סדנאות:

האתר מציע מידע כללי אודות סדנאות תכשיטים המועברות ע"י GOLDA.

הזמנת סדנאות, תשלום, תיאום וביטולים – מבוצעים ישירות מול GOLDA במייל או טלפונית.

לא ניתן להזמין סדנה או לבצע עסקה בנוגע לסדנאות דרך האתר.

פרטיות ואבטחת מידע:

הנתונים האישיים נשמרים בהתאם לחוק הגנת הפרטיות.

האתר מאובטח בטכנולוגיית SSL ומבצע סליקה דרך חברת PayPlus.

לא יימסר מידע לצדדים שלישיים, למעט לצורך השלמת ההזמנה או כחובה חוקית.

האתר עושה שימוש בעוגיות לצרכים תפעוליים, שיווקיים ואנליטיים.

קניין רוחני:

כל זכויות הקניין הרוחני שמורות ל-GOLDA.

אין להעתיק, לשכפל, לפרסם או להפיץ תכנים מהאתר (כולל תמונות, טקסטים, שירים, לוגו, עיצובים וכו') ללא אישור בכתב.

 שימוש בהקלטות קוליות – הגבלת שימוש מסחרי

GOLDA יוצרת את ההקדשות המוזיקליות ללקוחות באמצעות שירות SUNO, בתשלום ובהתאם לרישיון שנרכש.
ההקלטות מיועדות לשימוש אישי בלבד – כחלק מחוויית המתנה.

🛑 חל איסור מוחלט להשתמש בהקלטות לכל מטרה מסחרית, לרבות:

  • הפצה פומבית למטרות רווח

  • שילוב בפרסומות, מוצרים, או תוכן מסחרי

  • מכירה או שימוש חוזר כלשהו של קובץ ההקלטה

השימוש בהקלטות כפוף לרישיון SUNO ולתנאי השימוש של GOLDA.
הפרת תנאים אלו מהווה עבירה על זכויות יוצרים וחשופה להליכים משפטיים.

ביטול עסקה מצד האתר:

החברה רשאית לבטל הזמנה בשל חוסר מלאי, טעות בפרטים או כל סיבה אחרת.

במקרה כזה יוחזר ללקוח מלוא הסכום ששולם.

הגבלת אחריות:

החברה לא תישא באחריות לנזקים ישירים או עקיפים שנגרמו עקב שימוש באתר או במוצרים.

במקרים בהם נגרם נזק עקב שירותי צד ג' (כגון שליחים או חברות סליקה), האחריות תחול על נותן השירות החיצוני.

אחריות החברה מוגבלת לסכום העסקה בלבד.

GOLDA is the exclusive owner of the website https://www.goldagift.com, which offers handcrafted jewelry combined with a personalized musical dedication (hereinafter: “the products”).

Use of the website is subject to these Terms & Conditions and constitutes full agreement by the user (hereinafter: “the customer”) to all conditions herein.
For convenience, this document is written in masculine form but refers to all genders equally.

Purchases

  • Purchases may be made only by users aged 18 and above, or with the approval of a legal guardian.

  • Placing an order constitutes full acceptance of these Terms & Conditions.

  • After placing an order and completing payment, the customer will receive an email confirmation.

  • Orders require submission of complete personal details, payment information, and—when ordering a musical dedication—a short content form.

Musical Dedication

  • Each musical dedication is uniquely created based on the details provided by the customer.

  • Once the order is approved, the creation process begins immediately.

  • Cancellations or changes to the dedication (lyrics, melody, voice, or any other element) are not permitted once production has begun.

Delivery

  • Delivery is by courier only, at a cost of 35₪.

  • Orders over 499₪ are eligible for free shipping.

  • Self-pickup is not available.

  • International shipping is not available at this stage.

Delivery Times

  • Standard jewelry: up to 5 business days from shipping date.

  • Jewelry with musical dedication: 7–10 business days from shipping date.

  • It is the customer's responsibility to ensure availability for delivery coordination.

Cancellations & Returns

  • A standard (non-personalized) item may be returned within 14 days of receipt, unused and in its original packaging.

  • A cancellation fee of 5% or 100₪ (whichever is lower) will be deducted.

  • Shipping fees are non-refundable.

  • Items with a musical dedication or any personalized product cannot be canceled or returned, in accordance with Israeli Consumer Protection Law, Section 14(c).

  • In case of product defect, the customer must contact us within 3 business days with documentation. After review, a replacement will be provided.

  • Refunds will be issued via store credit only.

  • Exchanges or credit card refunds are not available.

Product Responsibility & Care

  • GOLDA guarantees high-quality finish and inspection of each product.

  • We are not responsible for damage caused by misuse, water, perfume, wet storage, or physical impact.

Care Instructions:

  • Do not stretch or pull the jewelry.

  • Remove before bathing, swimming, or contact with water.

  • Store in a dry, closed jewelry box.

  • Avoid contact with cleaning agents, creams, or perfumes.

Workshops

  • The site provides general information about jewelry workshops hosted by GOLDA.

  • Booking, payment, and coordination are handled directly via email or phone.

  • Workshops cannot be booked or purchased through the website.

Privacy & Data Protection

  • All personal data is stored in accordance with Israeli Privacy Law.

  • The site is secured with SSL encryption and payments are processed via PayPlus.

  • Data is not shared with third parties, except as required to complete an order or by legal obligation.

  • The site uses cookies for operational, marketing, and analytical purposes.

Intellectual Property

  • All intellectual property rights are reserved to GOLDA.

  • No content from the site (including images, texts, songs, logos, or designs) may be copied, reproduced, published, or distributed without written permission.

Voice Dedications – Commercial Use Restriction

GOLDA creates musical dedications for customers using the SUNO platform, under a paid license.
All recordings are for personal use only – as part of the gifting experience.

🛑 Commercial use of the recordings is strictly prohibited, including:

  • Public distribution for profit

  • Use in advertisements, products, or monetized content

  • Resale or reuse of the audio file in any form

Recordings are subject to SUNO’s licensing and GOLDA’s terms of use.
Violation of these terms constitutes copyright infringement and may result in legal action.

Order Cancellation by GOLDA

GOLDA reserves the right to cancel any order due to lack of stock, error in details, or for any other reason.
In such cases, the full amount paid will be refunded.

Limitation of Liability

GOLDA shall not be held liable for any direct or indirect damage resulting from use of the website or its products.
For issues related to third-party services (e.g., couriers, payment providers), responsibility lies with the respective provider.
GOLDA’s liability is limited to the value of the transaction only.
